The Standard Chartered bank has been ordered to pay a sum of Rupees 15000 to a female client for refusing to issue her a no-objection-certificate (NOC) for ownership of a car inspite of having repaid the loan amount.
Consumer dispute redressal forum president Mr. M.L Sahani holding the bank responsible for deficiency in service also directed it to issue the NOC.
The complainant Mrs. Ishwar Devi Chaudhary had availed of the banks loan for the procurement of a Maruti Esteem, and therefore had the right to move the court for failure on the banks part to issue her the NOC which lead to harassment and loss to the complainant. According to forum members Mr. S.C Kaushik and Nargis Rajukumar, the complainant Mrs. Ishwar Devi Chaudhary, a resident of South Delhi’s Mohammadpur had bought the car on hire purchase system after procuring a loan from the bank in question.
Inspite of the loan being repaid by December 2004, the bank refused to issue her an NOC for the vehicles transfer. Mrs. Ishwar Devi Chaudhary had initially sought a compensation of Rupees 50000, besides the NOC. In its defense, Standard Chartered bank had claimed that the complainant was not a costumer of the bank, and that some post dated cheques from her had bounced.
