Delhi district consumer forum president Mr. J.P. Singh said that this step was taken against Skoda Auto since it failed to rectify the defect with the car.
Mr. Jain, a resident of West Delhi who had purchased the Skoda Octavia in October 2005 noted certain defects with the car within the first four months. The engine was changed twice by the company as a result of the owners frequent visit to the service station, but the root problem still could not be rectified.
Even though there was no word from the company, the dealer Silver Tone Pvt Ltd stated that the problem was due to a non-genuine part installed in the car by the owner. "The manufacturers have failed to substantiate their defense by producing cogent evidence with regards to use of unauthorised fitments of non-genuine parts in the car", Mr. Jain stated. He had claimed that there were manufacturing defects with the car and had demanded that the company either replace the car or refund its price, insurance amount of Rupees 37000, and also a compensation of Rupees 20 Lakhs.
The Forum which also comprised of Mr. S.M. Majumdar and Mr. Krishna. K. Gupta, acting on the owners complaint directed Skoda Auto to replace the car of refund the purchase price within a month. Skoda Auto, a Czech company is a subsidiary of German carmaker, Volkswagen. During the month of March 2008, Skoda India saw a 27.2% rise in its car sales with 2050 units sold, out of which the newly launched super-hatch the 'Fabia', accounted for 720 units.
